Defective DePuy hip implant leads to severe pain, DePuy lawsuits

Throughout the United States, many people have been injured by a defective medical device for their hip replacement surgery. The negligent manufacturer is DePuy Orthopaedics, owned by the global pharmaceutical giant Johnson & Johnson. That company profits by many billions of dollars and in the process disregards its primary responsibility to its customers: their safety and well being.

Sold from the year 2003 until its U.S. recall in 2010, the DePuy ASR Hyp System made profits, too, via 37,000 sales domestically and 93,000 sales globally. But due to its device's failures, DePuy had to take of off the market in Australia in 2009, even while continuing to sell it for profits in the U.S. -- at least, until late August of 2010. That's when DePuy finally took its hip implant off the market in America, too.

The faulty implant is called either a DePuy ASR Hip Resurfacing System or an ASR XL Acetabular Hip System. DePuy issued a DePuy recall or hip replacement recall of these DePuy implants, but not before they’d already been placed in the bodies of many patients.

This leads to the bizarre idea of a negligent manufacturer demanding the “recall” of an implant which has to be surgically removed from the victim’s body to be recovered. Such removal is called “revision” surgery, which DePuy says it will fund. But DePuy also wants to reclaim the devices and try to mitigate its costs in a possible hip replacement lawsuit or DePuy lawsuit.

DePuy even says it will help its victims through a “help line” phone number given on its website. But the only true help will be going to DePuy itself, which is using an insurance adjuster -- whose job is to diminish claims -- to conduct and tape record such conversations for possibly using them against victims in court.

DePuy even has tried to blame a U.S. military veteran for his own hip replacement surgery injury, by claiming that his own behavior, and not DePuy’s defective medical device, is at fault. The result is that a veteran of the Gulf War has faced not only torment via a defective DePuy implant, but is having to fight for his legal right to gain fair and just financial compensation.

That economic recovery should go beyond the hip revision surgery DePuy offers to fund. Rather, it also should include all associated medical costs, as well as all lost wages due to the hip replacement surgery injury, as well as all the pain and suffering endured by victims.

Such compensation can come with an experienced lawyer or attorney for a hip replacement lawsuit. Victims of DePuy’s negligence can find such legal representation no matter which state in which they live, thanks to the nationwide attorney group of USA-LegalHelpCenter.com.
