An ATV accident may merit an ATV lawsuit
An ATV, or all-terrain vehicle, is supposed to be all about thrilling fun, as riders bounce and rumble across rugged, rough, off-road tracks and trails for the sheer enjoyment of the adventure. But unfortunately, such fun may turn to fearsome tragedy due to the tendency of some ATVs to tip or roll over, seriously injuring and even killing drivers and passengers.
Perhaps the most likely ATV to tip or roll over is the Yamaha Rhino. Designed and manufactured by Yamaha Motor Corp., the Yamaha Rhino has a narrow wheelbase and narrow tires, which enable it to fit onto the back bed of a pickup truck for transporting to off-road sites. (It's illegal in many states to drive an ATV on public streets and highways.) Yet this same narrow design, couple with the Yamaha Rhino's top-heavy nature, that make it susceptible to tipping or rolling over, even when driven slowly and on a flat surface.
Thus, the problem isn't the weather, the track or the driver, but the Yamaha Rhino itself. Already, Yamaha Rhino ATV accident lawsuits are in state and federal courts. Meanwhile, Yamaha has yet to recall such inherently unsafe vehicles, but rather only has offered to make a no-charge upgrade to those already purchased. This offer to upgrade, by adding side doors and handlebars, is in effect an admittance by Yamaha that its vehicle is unsafe and needs modification.
Since the Yamaha Rhino ATV was introduced to consumers in 2003, it has sold many units, and Yamaha Motor Corp. has had hundreds of millions of dollars in income. Such vehicles can cost more than $10,000, and consumers have a right to expect that they are designed with their safety in mind. Sadly, the Yamaha Rhino is not. In fact, it is perhaps the most unsafe ATV in America. Yet in most cases a person needs no license and gets no training to operate it, even though the vehicle is highly unstable. Of course, even the best driver might not be able to avoid an accident on a Yamaha Rhino.
If you or a member of your family has been harmed in a Yamaha Rhino ATV accident, you should promptly alert a skilled Yamaha Rhino accident lawyer or attorney for support. Such an attorney or lawyer can pinpoint the nature and cause of your accident, assess the nature and extent of your injuries, and determine an appropriate goal for financial recovery. He or she then can fight to ensure your legal rights are upheld and you are financially compensated for your Yamaha Rhino ATV accident losses, including medical bills, lost wages and pain and suffering.
